The reasoning, as best as can be reconstructed, is that you cannot compel a foreign lab to submit its weights for review.

This is accurate. It is also a description of the entire problem, repackaged as a solution.

Open-weight models, once released, exist everywhere simultaneously. They have no update mechanism, no killswitch, and no terms of service that a determined user is obliged to read. Exempting them from safety tests does not make them safer. It makes the paperwork tidier.

Why the humans care
